Amanda Bynes, 26, was arrested on suspicion of drunken driving after allegedly hitting a sheriff's patrol car.

The last time Amanda Bynes was accused of a ding-and-dash, she said she didn't know anything had happened.

So, maybe she didn't know it this time, either?

Well, according to the actress herself, a TMZ report about her being accused of crashing into another car on an L.A. freeway last month and zooming off is a "fake story."

Well, the story exists, but Bynes maintains that she was most certainly not involved in any such thing.

"I can't help but laugh at all of you writing fake stories about me. I was not in any hit and runs," Bynes tweeted Sunday. "I don't drink so the DUI is false."

That last bit apparently referred to her on-the-record run-in with the law.

Bynes has not been charged yet, but she is due in court on June 6 in connection with her April 6 arrest on suspicion of driving under the influence.

Her father also said at the time that his daughter does not drink, but the incident ended up preceding two other vehicular mishaps.

On April 15 a number of witnesses saw her comically block traffic in West Hollywood while executing a three-point turn, and a collision report was filed earlier this month by a man who says she grazed his SUV with her car but didn't stop. (That's the incident Bynes said she was unaware of until authorities contacted her.)

As for her alleged freeway crash, TMZ reports that no action was ever taken because no independent witness could confirm what had happened.

Under Performance Measures, states receiving a grant under this title

? 1. Shall demonstrate effective development, operation, and expansion of a community-based and prevention-focused programs and activities designed to strengthen and support families to prevent child abuse and neglect that MEETS THE REQUIREMENT OF THIS FEDERAL TITLE.

? 7. shall describe the outcomes under the State program to demonstrate the effectiveness in meeting the purposes of the program;?

In other words when states accept Federal Grant Money for Child Abuses Prevention, and are mandated the states SHALL follow Federal Guidelines.

? State Child Protection Laws exist in all 50 states. All states accept Federal Grant Money for Child Abuses Prevention.

Thus, State Laws must MEET THE REQUIREMENT OF THIS TITLE, Public Law. 111-320, the CAPTA Reauthorization Act of 2010. For example, Kentucky Child and Youth Protection Law: Kentucky Unified Code KRS 600-645. Juvenile/Family Court has exclusive jurisdiction for Child Abuse.

Anyone who is Responsible for Child Safety, Care, Welfare, Injury and/or Disease Management, even if it is only for the referral to the proper Medical Personnel, particularly when that person(s) has Temporary Substitute Custody and Control of the Child, should be Licensed by the state.

In the United States, the ?Parens Patriae? doctrine is most often applied to the treatment of children.

The state is the ?Supreme Guardian? of all children within its jurisdiction and state courts have the inherent power to intervene to protect the Best Interests of Children. This inherent power is legalized and Offenders of Children are criminalized by legislative Laws that describe the extent of child protection in a state

The basis for government?s intervention in child physical and psychological maltreatment and endangerment, sexual abuse and Human Rights violations are based in the concept of ?Parens Patriae?.

Legally, ?Parens Patriae? refers to the public policy and power of the state to intervene against an abusive or negligent parent, legal guardian or caretaker, and to act as the caretaker of any child or individual who is in need of protection.

?Parens Patriae? asserts that government has a role in protecting the interests of children and in intervening when parents and other caretakers fail to provide proper Child Care.

While it has long been recognized that parents have a fundamental liberty, protected by the Constitution, to raise their children as they choose, they must do so according to the standards of Law.

If parents, guardians and caretakers are unable, unwilling or fail to protect or properly supervise their Children and fail perform this responsibility, the State in which they reside has the power and authority to take action to protect the child from harm. [46.]

The legal framework regarding the parent-child-state tripartite relationship balances the rights and responsibilities among the parents, the child, and the State, as guided by Federal statutes, The Child Abuse Prevention and Treatment Reauthorization Act of 2010, Public Law 111-320, first enacted in 1974 and amended several times since then.

?Most licenses expire after a certain period of time, and most can be renewed. Failure to abide by certain laws and regulations can result in suspension or revocation of a license.?

?The licensing process helps to control activity in a variety of ways. License application procedures allow government authorities to screen applicants to verify that they are fit to engage in the particular activity. Before any license is issued by an agency or State Board, the applicant must meet certain standards.?

?Requiring a license for a certain activity allows the government to closely supervise and control the activity. The agency responsible for issuing the license can control the number of licensees.?

?A license is not a property right, which means that no one has the absolute right to a license. The government may decline to issue a license when it sees fit to do so, provided that the denial does not violate federal or state law. No agency may decline to issue a license on the basis of race, religion, sex, national origin, or ethnic background.?

All Doctors, Nurses, Trainers who are allowed by law to care for the Health and Welfare of Athletes are state licensed. Parents are likewise state licensed for Child Protection and Proper Supervision of their children by Birth Certificates and Guardians by Court Orders.

Anyone who has mandated Child Protection and Proper Supervision Responsibilities, like Extracurricular Coaches, should be state licensed.

The American Academy of Pediatrics Policy Statement for Child and Youth Sports Participation says that organized Sports can have many positive benefits for Child and Youth Athletes Provided adjustments are made in Sports when Sports, Recreation and Exercise (SRE):

? Provide a greater opportunity to develop rules specifically designed for health and safety of Children and Youth.
? Allow for the establishment of developmentally sound criteria for determining readiness for children and youth to participate in Sports.
? Allow for a fair process and enforcing rules. Rules specifically targeted at younger athletes can reduce injuries. Recommendations have been made to limit dangerous practices
? Safety accommodations associated with organized youth sports include many recommendations for the Sport Environment.
? The availability of Qualified Coaches in organized sports can be a key factor in providing safety and a positive experience
? Because most youth sports coaches are volunteers with little or no formal training in child development, they cannot be expected to correctly match demands of a sport with a child?s readiness to participate.
? Educational programs are available for Youth Sports Coaches, but most coaches do not participate.
? Coaches may try to teach what often cannot be learned and blame resulting failures on shortcomings of athletes
? Pediatricians can further advocate safe sports participation by promoting better education and training of youth sports coaches.
? Standards for coaching competency are available and certification for youth sports coaches should address these competencies. [50.]
? Pediatricians can work with sports administrators and coaches within their community and share relevant information on child development, injury assessment, first aid, and injury prevention. and take an active role in developing safety programs while ensuring that existing safety measures are observed [49.]

Coaching Certification Courses are offered by many schools. The United States Sports Academy, for example, offers Coaching Certification Courses. Certification of Coaches will enhance their qualifications for a State Coaching License.
U.S. High School Athletic Associations (HSAA) oversee 24 %, 11,000,000 of School and Non-School Child Athletes (

That leaves 34,000.000 Child Athletes in Grade School, Middle School, JV Teams, summer leagues, Church leagues, Swimming, Cheerleading Camp etc. that are not administered by HSAAs and don?t have comparable HSAA oversight and Safety laws that have been enacted by the Legislative Branch of State Governments.

Child Athlete Abuse Syndrome (CAAS) Education is seldom educated or mentioned in School and Non-School Sports. Licensure would significantly reduce sexual abuse and other abuse cases such as heat stroke, rhabdomyolysis, overuse injuries, post-traumatic stress disorder etc that are inflicted, caused or created on our Child and Youth Athletes.

The Definition of the Standard of Care for a Child requires that a Child must have:

? Proper Child Custodial Protection
? Proper Child Supervision
? Child Safety
? Child Health and Well Being
? Protection from Abuse and other forms of Violence
? Protection from Neglect. The Definition of Neglect is ?any recent act or failure to act on the part of a parent or caregiver, which results in death, serious physical or emotional harm, sexual abuse or exploitation, or an act or failure to act which presents an imminent risk of serious harm,? [36.][45.]

SRE are not above the Law. College Football is not a closed society, resistant to outside intervention when Crimes occur. College Football and all SRE are not impervious to the Rules of Law. Even Colleges have minor aged Athletes.

?College Football is not a kingdom unto its own,? said Former Secretary of State Condoleezza Rice [46.]

THE SPORTS, RECREATION AND EXERCISE (SRE) COACHING ACT.

? Enormous Power Gap that exists between Coach and Athlete
? Must be able to Recognize Child and Youth Athlete Emotional, Physical and Injury Conditions
? Serve as Para-Medical Trainers and make examination and treatment decisions when Health Care Providers are not available.
? Prominent, powerful Coaching profession where mistakes are damaging and costly to precious life.
? Certification alone is not sufficient and does not insure oversight by any governing body.
? 50% of Child and Youth Amateur Athletes participate in School Sports and 50% in Non-School Sports
? Non-School Amateur Child and Youth Athlete Sports participation has added Protection and Safety deficiencies
? Rules, Regulations and By-Laws of National and State Amateur School and Non-School leagues, federations and associations do not include the Rules for Child and Youth Protection Laws that have been enacted into Law.
? National and State Amateur School and Non-School leagues, federations and associations foster ?Closed Sports Societies? that appear to want-to-be impervious to outside interference and the Rules of Law because Child Abuse Laws are not published to the Sport Culture and Athletic Community.

STATE BOARD OF COACHING LICENSURE

The State Coaching License, administered by The State Board of Coaching Licensure, would legally

? Proclaim, enforce and administrate its Licensure Authority
? Promote the Special Standard of Care for Child and Youth Athletes like Care for all other Children and Youth
? Prevent Child Athlete Abuse.
? Ensure that Child and Youth Athlete Care follows the Rules of Law not the Rules of Sport posturing as a Kingdom unto its own.
? Promulgate Child Protection and Supervision Laws
? Responsible for protecting Child and Youth Athletes by ensuring that only qualified Coaches are licensed to Coach in the state
? Initiate appropriate disciplinary action when violations of the Amateur Coaching Act occur.
? Refer any Unlawful Coaching Behaviors and Actions to the Child Protective Services and County Attorney when appropriate.

Be it enacted by the General Assembly of the Commonwealth of Kentucky]:
?Section 1. (1) The Kentucky High School Athletics Association, with assistance from the Kentucky Department of Education, shall staff and coordinate a study of sports safety to be completed no later than October 1, 2009.
(2) The study shall include a review of:
(a) The requirements and their adequacy for sports safety education in public middle and secondary schools, including heat-related and air quality issues, chronic and overuse injuries, and other risk factors;
(b) Required training programs for secondary school coaches, to include how training is certified to demonstrate knowledge and competencies of participants;
(c) Required first aid and medical assistance protocols or standards of care for students suffering minor and major injuries during practices and competitions;
(d) Data regarding sports injuries, by sport, in Kentucky and an examination of data reporting requirements and responsibilities for oversight when injuries occur;
(e) Education for high school coaches, volunteers, parents, and student athletes relating to nutrition, weight training, and the dangers of steroids and other illegal supplements;
(f) The availability of sports injury prevention programs and other safety resources; and
(g) Other information as deemed appropriate by the study group to fully examine the status of sports safety in Kentucky for high school students.
(3) The Association shall have a formal work group composed of:
(a) At least two (2) members of the Kentucky Board of Education, selected by the board chairman;
(b) At least two (2) representatives from the Kentucky Department of Education, selected by the commissioner of education;
(c) At least two (2) high school coaches selected by the Chair of the Board of Control;
(d) At least two (2) members from the Kentucky Medical Association, appointed by the executive director;
(e) At least three (3) certified sports trainers; and
(f) Others as deemed appropriate by the commissioner of education and the executive director of the Kentucky High School Athletics Association.
(4) The commissioner of education or designee and the executive director of the Kentucky High School Athletics Association shall identify the work group members within thirty (30) days of the effective date of this Act.
(5) The Association shall submit a written report to include findings and recommendations to the Interim Joint Committee on Education by October 30, 2009. The report shall include but not be limited to recommendations to improve the safety of students participating in high school athletics and any legislation that might be necessary to implement the recommendations.
?SECTION 2. A NEW SECTION OF KRS CHAPTER 160 IS CREATED TO READ AS FOLLOWS:
(1) The Kentucky Board of Education or organization or agency designated by the board to manage interscholastic athletics shall require each high school coach to complete a sports safety course consisting of training on how to prevent common injuries. The content of the course shall include but not be limited to emergency planning, heat and cold illnesses, emergency recognition, head injuries, neck injuries, facial injuries, and principles of first aid. The course shall also be focused on safety education and shall not include coaching principles.
(2) The state board or its agency shall:
(a) Establish a minimum timeline for a coach to complete the course;
(b) Approve providers of a sports safety course;
(c) Be responsible for ensuring that an approved course is taught by qualified professionals who shall either be certified athletic trainers, registered nurses, physicians, or physician?s assistants licensed to practice in Kentucky; and
(d) Establish the minimum qualifying score for successful course completion.
(3) A course shall be reviewed for updates at least once every thirty (30) months and revised if needed.
(4) A course shall be able to be completed through hands-on or on-line teaching methods in ten (10) clock hours or less.
(5) (a) A course shall include an end-of-course examination with a minimum qualifying score for successful course completion established by the board or its agency.
(b) All coaches shall be required to take the end-of-course examination and shall obtain at least the minimum qualifying score.
(6) Beginning with the 2009-2010 school year, at least one (1) person who has completed the course shall be at every high school athletic practice and competition.
?Section 3. Whereas there is no existing requirement for a medical professional to be on-site during high school athletic events and the safety of student athletes is sometimes compromised, an emergency is declared to exist and this Act takes effect upon its passage and approval by the Governor or upon its otherwise becoming a law.

21st century bloodletting reduces cardiovascular risk

ScienceDaily (May 29, 2012) ? It seems that while the practice of bloodletting throughout history had little or no effect on most diseases, and the practice was abandoned in the 19th century, new research published in BioMed Central's open access journal BMC Medicine demonstrates that blood donation has real benefits for obese people with metabolic syndrome. Two sessions of bloodletting were enough to improve blood pressure and markers of cardiovascular disease.

Metabolic syndrome is the name given to a host of difficulties affecting people who are obese. This includes insulin resistance, glucose intolerance, dyslipidemia and hypertension and leads to an increased risk of diabetes and cardiovascular disease. Since it is known that accumulation of iron in the body is also associated with hypertension and diabetes researchers from Berlin and University Duisburg-Essen randomly assigned patients with metabolic syndrome into two groups, those undergoing iron reduction by phlebotomy and controls.

The iron-reduction patients had 300ml of blood removed at the start of the trial and between 250 and 500ml removed four weeks later. Six weeks later, allowing plenty of time for blood volume to be replaced, the patients who gave blood had a significant reduction in systolic blood pressure (from 148 mmHg to 130 mmHg) as well as reduction in blood glucose levels and heart rate, and an improvement in cholesterol levels (LDL/HDL ratio).

Prof Andreas Michalsen from the Charit?-University Medical Centre, Berlin, who led this research explained, "Consecutive reduction in iron stores was able to improve markers of cardiovascular risk and glycemic control. Consequently blood donation may prevent not just diabetes but also cardiovascular disease for the obese. Obviously this treatment will not be suitable for people with anemia however for those eligible for treatment blood donation may prevent escalation of their condition."

Another Party Heard From on Legal Education

Via links in some comments, here's an addendum to my discussion last week of practical- or client-centered legal education (which, as you recall from that post, didn't seem to get much love from the constituents on the Campos blog last week). It's a post?by Dru Stevenson at the Circuit Splits blog, which I'm afraid I wasn't aware of, titled "Should Law Schools Focus on Lawyering Skills?" Stevenson argues the answer is no. A snippet or two:

I . . . disagree with the nationwide push toward making law schools into trade schools, the attempt to make the institutions less intellectual. ?And I recently blogged?here?about the direction I would like to see schools go--echoing the vision recently outlined by the Dean of the law school at Boalt Hall (California-Berkeley). ?Comparing law to another profession, would you prefer that your surgeon had spent more time taking courses on "counseling patients," and "medical clinic management," or more time studying cellular biology and organic chemistry? For my surgery, I would prefer the one who had a more intellectually rigorous program, not one that focused on role-playing exercises and rudimentary paperwork-completing skills. ?I wonder if any other profession criticizes its theoretical wing like ours does.?

The most troubling aspect of turning the focus of law schools completely toward "skills" is that this is the seed of our institutions' destruction. When a consensus finally emerges that the whole point of law school is training kids in the mechanical tasks of lawyering - how to write a brief, how to give an opening argument, how to look up the law on something - people will then realize that law schools are not really necessary at all for teaching "skills" - these are better learned by "doing" and by repetition. A law school with a skills curriculum is a law school that is not worth the time or tuition, as the same skills would be better learned on the job in apprenticeships. ?After we all switch to teaching mechanical skills, there will be a movement to abolish law schools completely. ?The academic study of law will get absorbed back into the political science departments from whence it came, and lawyer training will be done the same way we train & license paralegals. . . . ??

In terms of marketable skills, there is an inconsistency between what the firms?say?they want and what the firms?do?when they hire new graduates. The firms say they want "practice ready" associates and complain that the law schools are too theoretical; but when given the opportunity to hire graduates from the HALF of the law schools that are mostly practice-oriented and non-theoretical, they pass over them and hire associates from the top 100 law schools instead - year after year, decade after decade. ?I know that some in the legal academy do not believe in rational markets or market discipline, so they would dismiss this as "all the firms are being stupid," or would say that the hiring partners at big firms are fooled by the prestige or brand names of elite schools. ?It's really strange, though - that after decades in practice, the graduates from the "skills" schools do not seem to rise to the top of the profession enough to influence or change the hiring patterns. ?One might expect at least?some?of the firms to realize that the "skills" schools are producing superior lawyers ("practice ready") and that some would switch to interviewing on their campuses instead of the elite schools. ?It just doesn't happen - year after year, graduates find it easier to get jobs if their diploma is from a more elite (read: more theoretical) law school. The graduates from lower-ranked law schools are much more likely to find themselves unemployed and having to start their own solo practices. The hiring market has never backed up the claims that students are better off being taught lawyering skills instead of higher thinking about the law. Law firms overall prefer to hire students from schools that tilt toward legal theory. The shift toward skills is not a response to market pressure; it runs?counter?to the market.?

Prof. Stevenson makes clear that he comes from a practically oriented school, so I appreciate hearing his perspective. I must respectfully disagree with him, however--and I say that as one who does write on the "intellectual" side and doesn't think there's anything wrong with that for individual professors. (Although being a theory type doesn't absolve one of one's fiduciary duty to ask what is best for legal education on the whole, and particularly what is best for one's own school and students.) There is no doubt that other professional wings of education do?face the same tensions and criticisms. Boalt's model is interesting, but we should no more treasure the idea of making every school more like Boalt than we should the idea of making every school more like Yale, or indeed more like any specific school.

The second paragraph excerpted above--the one that worries that "turning the focus of law schools completely toward 'skills' is . . . the seed of our institutions' destruction"-- is interesting. But I don't see why we should think of this as a bad thing in and of itself. I might (or might not) feel differently about it if every?school took this path, but if it happened in a number of places I'm not sure that Stevenson has shown why that would be so terrible.?

Finally, I agree with Stevenson that there appears to be "an inconsistency between what the firms?say?they want and what the firms?do?when they hire new graduates." But: 1) his paragraph seems heavily weighted in terms of the behavior of Biglaw firms; 2) I do believe there is a "firms are being stupid" element to this--or, put differently, I think the big firms' credentialism is (or was) partly client-driven but is also a function of foolish reproductive tendencies at those firms and hurts their business in the long run; and 3) in any event, as I argued earlier, and especially given the reality that most students don't end up at these firms regardless, it still makes sense to me to ask, not what firms want, but what clients need.?

In any event, I was happy to hear a different point of view. Read it for yourself. A couple of good comments there as well. And no, I do not think discussing this issue obscures the "it's the jobs/money" arguments, which remain important.

He's also glossing over something really important in that third paragraph: that regardless of the curriculum taught at the elite law schools, they will, on average, have smarter crops of students who are more likely to become good lawyers (see, e.g., Scalia on law clerk hiring: "The best minds are going to the best law schools. They might not learn anything while they?re there, but they don?t get any dumber."). So, all that really tells us is that firms feel the long-term potential and higher average intelligence of grads from the top schools outweighs whatever level of practice-readiness they'd have from grads of lower-ranked schools. If some of those top schools did focus on practice-readiness over theory (say, if Harvard, Columbia, UVA, and Georgetown switched to a practice-focused curriculum), we could then look at the data and have a valid basis of comparison. Without that, though, just comparing the practice-focused, low-ranked schools to the theory-focused, high-ranked schools is ignoring a staggeringly important variable.

(By the way, I don't mean to say there aren't smart students at, for instance, Alabama. Just speaking in averages and perceptions here).

Law schools need to focus on both. While a greater focus on skills-based learning is necessary. intellectualism should not be abandoned. They are both equally important to the creation of well-qualified practitioners.

I disagree with Dr Richards about the impact of these allegedly smarter students at higher tier law schools. These students might be exceptional test-takers but that doesnt meqn that on average they will be better practitionere. They will simply get better and more opportunity due to this faulty perception. I have encounterer far too many graduates from elite schools with great brains and poor common sense, which equates to inadequate lawyering skills. But alas, thus perception will likely not change...unfortunately.

I'm with Stevenson, and we do have data: Northwestern has for years been marketing itself as a "practical" elite school. Far as I know they've done fine, but no better than comparably ranked schools, like Duke, Cornell, Michigan, and UVA, in the market. Certainly there's been no market rush to Northwestern by firms to gobble up their "practice-ready" grads. Maybe this is because school can only prepare someone so much for practice.

Please permit me to offer two thoughts on this important debate.

1. Focusing on the hiring practices of the largest, most elite firms ("Biglaw") is likely not the best way to ascertain the future course of the market for law school graduates. This is the sector of the market that provided the most inefficient services to clients, and therefore experienced the most profound transformation as a consequence of the current recession. Preparing lawyers to work in Biglaw is rather like to preparing journalism students to work at print newspapers. There will always be some volume of work where the financial stakes are so high that clients will be willing to pay the kind of fees that Biglaw requires for that model to work, but the market is going to continue to push law firms for a higher ration of value received to cost charged, and firms with high fees that fund high compensation and costs will be at a serious disadvantage. Firms that hire lawyers that can more quickly provide cost-effective service to clients, in contrast, will be at an advantage. Hence, the demand for skills training emanating from both clients and legal employers.

2. Yet, even Biglaw tells us where the market is moving. Biglaw, regarding itself as the most elite market participants, naturally wants it both ways. It wants more practice-ready students since clients are no longer willing to pay for the training of young lawyers (and partners at Biglaw seem disinclined to have training costs come out of their own compensation), but Biglaw also wants smarts, since most Biglaw firms believe that the sophistication of their work demands that they hire "the best minds." Most Biglaw firms still consider a degree from an elite law school as the best proxy available for smarts. This is admittedly changing, though slowly, but it remains a prevalent view. Yet, the fact that even Biglaw wants law schools to provide more skills training, albeit at the most elite law schools from which they prefer to hire, tells us much about where the market will push legal education.

The essence of my criticism is that he has mischaracterized the legal reform movement. I agree with Paul that we need debate on this issue, but the debate must concern what is actually being argued, not a strawman view of the other side.

Gov. Walker, Mayor Tom Barrett Face-Off

DULUTH, MN (Northland's NewsCenter) - It was Milwaukee mayor versus standing governor at Friday's debate as challenger Democrat Tom Barrett took on current Republican Governor Scott Walker.

It was the first of two televised debates, and jobs were again a big talking point.

Job numbers in campaign ads have been a source of contention between the two candidates. Friday was no different. Both parties defended their job numbers.

They also debated collective bargaining reforms, the proposed mine near Mellen as well as the reason this election is happening in the first place.

While Barrett says Walker has caused neighbors to not be able to speak to neighbors because of politics, Governor Walker defended his reforms saying no one's talking about them anymore because the reforms are working, but he would change the process in the future.

Money from outside has been pouring in final weeks ahead of the election.

If Governor Scott Walker were to lose, he would be only the third recalled governor in the U.S. in history.

The election will be held June 5.

Several polls have been showing Walker with a slight lead.

Merged CEP/CAW union may open membership to unemployed and temporary workers

The CEP and CAW are continuing their discussions as they attempt to merge unions into one new national union.

The Proposal Committee, made up of 8 representatives from each union, met last week in Toronto and reached a consensus on?on a plan that establishes a ?robust regional presence? and outlines how the new union could be run.

The Proposal Committee has brought forward a number of important ideas on the set up of the new union that would build union density across the country and establish new models for organizing,? said CAW President Ken Lewenza.

CEP President Dave Coles said ?one of the goals of the project is to develop new ways to organize those who haven?t traditionally had a chance to belong to unions. We need to give them a voice,? he said. ?The new union initiative is a reaction the Harper?s government?s bullying of workers,? added Coles.

Proposals for New Union:

  • would have a critical mass in every region of the country, unlike both separate unions now
  • local unions would take part in regional councils in B.C., the Prairies, the Atlantic and Ontario. Quebec would also have its own council
  • would have three elected national officers ? President, Secretary-Treasurer and Quebec Director, in addition to three elected regional directors from Atlantic Canada, Ontario and Western Canada
  • greater outreach to unorganized workers ? a new?category of membership would be created to allow unemployed workers, those in workplaces that are not yet certified, young workers and precarious or temporary workers, to also join the union

Further Proposal Committee meetings are slated for late May and June.

The final report and recommendations of the Proposal Committee will be submitted to the CAW Constitutional Convention in August, 2012 and the CEP Constitutional Convention in October, 2012. Only after the two conventions approve the plan for a new union would steps go ahead to launch the new union.

India PM seeks to heal bad blood on Myanmar visit

SITTWE, Myanmar (Reuters) - In northwest Myanmar, where the Kaladan River flows out into the Bay of Bengal, the two giant arms of a half-built wharf enfold the estuarine mud with steel and concrete.

Their embrace is fraternal - Myanmar's giant neighbor India is funding the new port in Sittwe, the capital of Rakhine State - but also strategic.

The port is part of a $214-million river and road network that will carve a trade route into India's landlocked northeast and underscore New Delhi's determination to capitalise on Myanmar's growing importance at Asia's crossroads.

Manmohan Singh will seek to bolster ties this week during the first visit by an Indian prime minister to Myanmar in 25 years. His official agenda includes road, rail, waterways and air links, says India's foreign ministry.

Unofficially, he must also overcome a history of bad blood with Myanmar, where Indian investments are already dwarfed by regional rival China.

The visit follows a year of dramatic reforms in which Myanmar has pulled back from China's powerful economic and political orbit and won a suspension of U.S. and European sanctions. With change has come a series of high profile visits, including stops by the leaders of Britain and South Korea, as well as U.S. Secretary of State Hillary Clinton.

President Thein Sein's government has held peace talks with ethnic minority rebels, relaxed strict media censorship, allowed trade unions and protests and held a by-election dominated by Nobel Peace Prize laureate Aung San Suu Kyi's opposition party.

As Myanmar emerges from decades of isolation, trade with its neighbour is already swelling. Myanmar's government expects two-way trade with India to nearly double in two years to $2 billion, from $1.4 billion in the year to March 30, a figure that was nearly 30 percent higher from the previous year, according to Myanmar's Ministry of Commerce.

"Stronger trade and investment links, development of border areas, improving connectivity between our two countries and building capacity and human resources are areas that I hope to focus on during my visit," Singh said in a statement released before his arrival in the capital Naypyitaw on Sunday evening.

India should be a natural partner, with ties stretching back to the ancient Buddhist emperor Ashoka and, more recently, a shared experience of British colonialism and World War Two.

But its business interests in the former Burma have been "few and far between" since the mass expulsion of Indian merchants after the military seized power in 1962, says Thant Myint-U, author of "Where China Meets India: Burma and the New Crossroads of Asia".

"Many in India remember all too well that this was the country that nationalized Indian businesses and expelled hundreds of thousands of ethnic Indians with literally nothing more than the shirts on their backs," he said.

One hopeful symbol of improved ties is Sittwe.

The two countries formally agreed on the so-called Kaladan Multimodal Transit Transport Project in April 2008, just seven months after Myanmar's military junta crushed nationwide pro-democracy protests led by Buddhist monks.

Work began on Sittwe port in September 2010, shortly before the former military junta held a rigged election that brought to power a quasi-civilian but surprisingly reformist government.

Indian conglomerate Essar Group is building the port on 70,000 square metres (753,000 sq ft) of landfill in Sittwe's centre. It should be ready in two years, says Myanmar's Commerce Ministry, accommodating ships from the Indian city of Kolkata, a 539-km (334 mile) voyage away across the Bay of Bengal, and handling up to 500,000 metric tons a year.

From Sittwe, ships will sail up the Kaladan River to the town of Paletwa, where Essar will build a second, smaller port. A 122-km (76-mile) highway will connect Paletwa to the Indian state of Mizoram. The two ports and dredge work will cost $74 million. The highway will cost $140 million.

STRATEGIC SIGNIFICANCE

India is already Myanmar's third-biggest export market after Thailand and China. But Thant Myint-U plays down Myanmar's economic importance to India. "Myanmar is extremely important for India's northeast, but because the northeast itself rarely gets Delhi's attention, that in itself doesn't count for much."

However, New Delhi is acutely aware of Myanmar's strategic significance "because of China's increasing economic presence and anxiety about a possible future Chinese presence on the Bay of Bengal", he says.

Not far south of Sittwe, Chinese money is funding a bigger port and special economic zone in Kyaukphyu, a coastal town where Myanmar-China pipelines reach the Bay of Bengal, creating a passage from western China to South and Southeast Asia and allowing shipments of fuel and natural resources to avoid the Malacca Strait.

An Essar company official said "communication problems" had been a headache during the project, with Myanmar officials slow to provide information and language issues also a hurdle. The company, however, would consider further projects in the country, given they had already worked there.

"Business is all about relationships, and we have been meeting the right people," the official said.

A delegation of Indian business officials will join the prime minister on his visit, said an Indian Foreign Ministry official, adding that India was looking at setting up a special economic zone.

Indian companies are showing interest too.

Tata Motors, which makes the ultra-cheap Nano and owns Jaguar Land Rover, is looking to expand operations in Myanmar by assembling and selling buses and light commercial vehicles there, its India head said in January. Tata already operates a truck assembly plant in Myanmar.

State-run explorer Oil and Natural Gas Corporation Ltd, which has two gas blocks in Myanmar with production due to start in 2013, and tractor maker Escorts Ltd have also said they are looking to expand operations there.

Myanmar opposition leader Aung San Suu Kyi was once lionised by New Delhi, which gave her the prestigious Jawaharlal Nehru Award in 1993 and Myanmar's dictatorship the cold shoulder. Singh will meet Suu Kyi in the biggest city Yangon on Tuesday.

But with growing investment in Myanmar by regional rival China, the world's biggest democracy has forged closer ties, inviting former dictator Senior General Than Shwe on an official state visit to India in 2004.

Three years later, after he presided over a violent crackdown on pro-democracy protests led by Buddhist monks, India was widely criticized for its muted response amid international outrage.

"Manmohan Singh has to do more than offer ports, bridges and roads, as the Chinese do," says Thant Myint-U. "Instead, he has to ... delve deeply into the very long history of cultural ties between the two countries and come up with a new vision for Indo-Burmese relations.

"The problem is that no one in Burma thinks of India when they think of the future."

Still, Myanmar expects to benefit from the Sittwe project, partly from jobs. Essar employs 600 local people on the Sittwe site, although it brought in most of its skilled workers and specialist construction equipment from India.

"This project is good for the northeast part of India and for Myanmar," Myanmar Industry Minister Soe Thein said in an interview with Reuters in Naypyitaw. "We can't do it ourselves due to the lack of budget and problems in our financial sector."
