Priest, teacher convicted in Pa. church abuse case

PHILADELPHIA (AP) ? A jury on Wednesday convicted a priest and teacher in a pivotal church-abuse case that rocked the Philadelphia archdiocese and sent a church official to prison for child endangerment.

The verdict upholds the stunning account from a troubled 24-year-old policeman's son that he was sexually abused as a boy by two priests and his sixth-grade teacher. One priest took a plea deal before trial, while the jury convicted the Rev. Charles Engelhardt and former teacher Bernard Shero of all but one count.

The 2009 complaint describing the abuse led to the landmark conviction last year of Monsignor William Lynn, the longtime secretary for clergy in Philadelphia. Lynn is serving three to six years in prison for his role transferring an admitted pedophile priest to the accuser's northeast Philadelphia parish. A string of priest victims testified in Lynn's case, but none said they had been passed around like the policeman's son.

"I'm overjoyed that there was a conviction, mostly because of this victim. I really didn't expect it," said Philadelphia District Attorney Seth Williams, an active Catholic who revived efforts to prosecute the archdiocese after taking office three years ago.

The accuser, now a gaunt young man, has battled heroin abuse since his teens and still has a drug case pending. And details of his story changed frequently over the years, even about whether Shero raped him in the classroom or in a parked car.

"The victim was demonized, cross-examined, ... dehumanized. I would understand how a jury could come to a different verdict," Williams said.

The accuser said the assaults began after Engelhardt caught him drinking altar wine in fifth grade. He said Engelhardt told fellow priest Edward Avery about their "session," prompting Avery to twice sexually assault the boy. And he testified that Shero raped him a year later, after driving him home after detention.

The jury convicted Shero, 49, of Levittown, of rape, indecent sexual assault and other charges. They convicted Engelhardt, 66, of Wyndmoor, of charges including indecent assault of a child under 13, corruption of a minor and conspiracy with Avery. The jury deadlocked on one count, an indecent sexual assault count against Engelhardt, after deliberating since late Friday.

Lawyer Burton Rose described Shero after the verdict as "very distraught, very distraught." He had told jurors that his introverted, visually impaired client was an easy target for a false accuser.

Defense lawyers had argued that the accuser was simply hoping for a payout from his pending civil suit against the archdiocese. His story defied belief, they said.

He initially told a church social worker he'd been raped for five hours by Engelhardt after Mass; beaten and tied with sashes by defrocked priest Edward Avery; and raped by Shero at school. None of those details emerged in his trial testimony.

"(He) is the walking, talking personification of reasonable doubt," argued defense lawyer Michael McGovern, representing Engelhardt, an Oblate of St. Francis.

The accuser's account got a boost when Avery entered a surprise guilty plea last year. But Avery startled the courtroom this month when he testified that he never touched the boy, but took the 2-1/2- to five-year deal to avoid a longer sentence at trial.

Williams called that turn of events something fit for a "Law and Order" episode.

"He pleaded because it was a good offer," Avery's lawyer, Michael Wallace, said Wednesday. "(Jurors) think that anybody who walks down the street with a collar is guilty."

Shero and Engelhardt were taken into immediate custody. They each face more than a decade in prison when they are sentenced in April. Their relatives were inconsolable.

The victim now lives in Florida and was not in court, although his parents were. He told jurors this month that he'd been clean for a year, after 23 stints in drug rehabilitation.

Thousands of people have accused priests around the country of abuse, but the complaints were routinely locked in secret church archives. Several states, including Pennsylvania, then extended the time limit for child sex-abuse victims to pursue criminal or civil action, although victim advocates want to see additional reforms.

Philadelphia prosecutors saw their chance to renew their exhaustive, but stalled, investigation into priest abuse with the policeman's son, whose claims were viable under the new statutes.

Williams decided to charge Monsignor Lynn because Avery had been transferred to the boy's parish even though he admitted to church officials that he had abused a teen in 1992. Lynn is appealing his conviction.

In September, Kansas City Bishop Robert Finn was convicted of a misdemeanor for failing to report a priest known to possess child pornography.

The victims' advocacy group Bishopaccountability.org recently began posting the secret church documents aired at the Lynn trial. And the Archdiocese of Los Angeles was forced to make many of their secret archives public.

"The Philadelphia archive will show why statutes of limitations must be reformed in Pennsylvania and elsewhere, and why Lynn and Finn will not be the last church officials to be held accountable," Bishopaccountability officials said.

According to a GQ-PAT Premium Update Sheet from GenomeQuest, GQ-PAT Premium now offers an Emerging Countries Domestic Patents Archive that covers ?domestic-only filed applications/patents with sequences from China, Brazil, India and an expanding list of counties?:

  • India: GQ has identified and acquired hundreds of India patents with sequences. These are being curated and formatted. 10 endangered pygmy elephants feared poisoned

Ten endangered pygmy elephants have been found dead in suspicious circumstances in Malaysia, according to reports.

Sen Nathan, head veterinarian at the Gunung Rara Forest Reserve in Sabah state on the island of Borneo, said officials "highly suspect" the animals were poisoned, but tests are still to be carried out to determine whether they were deliberately harmed, BBC News reported.


"It was actually a very sad sight to see all those dead elephants, especially one of the dead females who had a very young calf of about three months old. The calf was trying to wake the dead mother up," he said, according to the BBC.

Nathan added the elephants, aged between four and 20, were believed to be from the same family group.

Malaysia?s The Star newspaper said the first elephant died on Dec. 29 and the last was found on Jan. 24.

The paper reported that the dead animals were found in an area that it described as an ?industrial tree plantation.?

The Star said it was not known how the elephants had died, and noted it was possible they had eaten poisonous plants or pesticides.

The BBC cited Masidi Manjun, environmental minister for the Sabah area, as saying it was ?a sad day for conservation and Sabah.?

Conservation charity WWF runs an ?adopt a pygmy elephant? campaign.

According to its website, the animals are found ?only on the northeast tip of the island of Borneo, and inhabit forests near water sources and grasslands. ?

?Borneo pygmy elephants are smaller than other Asian elephants, chubbier, and have bigger ears and tails,? it said. ?They eat roughly 300 pounds of food daily?mostly roots, grasses, leaves, bananas and sugar cane.?

WWF estimates that there are possibly as low as 1,600 individuals in the wild.

?The top threats to pygmy elephants are habitat loss and conflict with humans,? it added.

Senate poised to approve Kerry nomination

WASHINGTON (AP) ? The Senate moved toward swift approval of President Barack Obama's choice of five-term Sen. John Kerry to be secretary of state, with Republicans and Democrats praising him as the ideal successor to Hillary Rodham Clinton.

Just hours after the Foreign Relations Committee unanimously approved the man who has led the panel for four years, the full Senate considered Kerry's nomination on Tuesday and planned an afternoon vote that was certain to be overwhelming in support of him.

Obama tapped Kerry, 69, the son of a diplomat, decorated Vietnam veteran and 2004 Democratic presidential candidate, to succeed Clinton, who is stepping down after four years. The Massachusetts Democrat, who had pined for the job but was passed over in 2009, has served as Obama's unofficial envoy, smoothing fractious ties with Afghanistan and Pakistan.

"Sen. Kerry will need no introduction to the world's political and military leaders and will begin Day One fully conversant not only with the intricacies of U.S. foreign policy, but able to act on a multitude of international stages," said Sen. Bob Menendez, D-N.J., who will succeed Kerry as committee chairman.

Sen. Bob Corker of Tennessee, the panel's top Republican, called Kerry "a realist" who will deal with unrest in Egypt, civil war in Syria, the threat of al-Qaida-linked groups in Africa and Iran's pursuit of a nuclear weapons.

Kerry, a forceful proponent of climate change legislation, also will have a say in whether the United States moves ahead on the Keystone XL pipeline from Canada, a divisive issue that has roiled environmentalists.

Kerry's smooth path to the nation's top diplomatic job stands in stark contrast to the harsher treatment for Obama's other national security nominees ? Chuck Hagel to be defense secretary and John Brennan to be CIA director.

Hagel, the former two-term Republican senator from Nebraska, faces strong opposition from some of his onetime GOP colleagues who question his support for reductions in the nuclear arsenal and cuts in defense spending. Lawmakers also have questioned whether he is sufficiently supportive of Israel and strongly opposed to any outreach to Iran.

Democrats have rallied for Hagel, and he has the announced support of at least a dozen members in advance of his confirmation hearing on Thursday. Six Republicans have said they would vote against him, with some opposing Obama's choice even before the president's announcement.

Brennan faces questions from the GOP about White House leaks of classified information and from Democrats about the administration's use of drones.

Sen. Lindsey Graham, R-S.C., threatened to block the nomination of both men until he gets more answers from the Obama administration about the assault on the U.S. diplomatic mission in Libya that killed Ambassador Chris Stevens and three other Americans.

Graham, who earlier this month signaled he would delay Brennan's pick, said in an interview Monday night with Fox News' "On the Record" the he would "absolutely" block Hagel unless Defense Secretary Leon Panetta testifies about the attack in Benghazi, Libya.

Clinton testified for more than five hours last Wednesday before the House and Senate, but that wasn't sufficient for Graham.

"Hillary Clinton got away with murder, in my view," he said. "She said they had a clear-eyed view of the threats. How could you have a clear-eyed of the threats in Benghazi when you didn't know about the ambassador's cable coming back from Libya?"

Senate Armed Services Committee Chairman Carl Levin, D-Mich., told reporters Tuesday that a hearing with Panetta on Libya is planned though the date is uncertain. Graham welcomed that news and said he would not thwart a committee vote on the nomination.

"Happy as a clam. News to me," said Graham, who met with Hagel for 20 minutes on Tuesday.

Pentagon spokesman George Little said Panetta had not responded yet to the request but that the department has been forthcoming with information. He insisted that the Hagel confirmation process move as quickly as possible.

As a White House emissary, Kerry has tamped down diplomatic fires for Obama. He also has stepped ahead of the administration on a handful of crises. He joined Sen. John McCain, R-Ariz., as an early proponent of a more aggressive policy toward Libya, pushing for using military forces to impose a "no-fly zone" over Libya as Moammar Gadhafi's forces killed rebels and other citizens. He was one of the early voices calling for Egyptian President Hosni Mubarak to step down as revolution roiled the nation two years ago.

During his tenure, Kerry has pushed for reducing the number of nuclear weapons, shepherding a U.S.-Russia treaty through the Senate in December 2010, and has cast climate change as a national security threat, joining forces with Republicans on legislation that faced too many obstacles to win congressional passage.

He has led delegations to Syria and met a few times with President Bashar Assad, now a pariah in U.S. eyes after months of civil war and bloodshed as the government looks to put down a people's rebellion. Figuring out an end-game for the Middle East country would demand all of Kerry's skills.

The selection of Kerry closes a political circle with Obama. In 2004, it was White House hopeful Kerry who asked a largely unknown Illinois state senator to deliver the keynote address at the Democratic convention in Boston, handing the national stage to Obama. Kerry lost that election to President George W. Bush. Four years later, Obama was the White House hopeful who succeeded where Kerry had failed.

Kerry would be the first man to fill the secretary of state job since Colin Powell eight years ago. Condoleezza Rice served as secretary of state in President George W. Bush's second term, and Clinton has held the post in Obama's first term.

US aid seems secure despite Egyptian turmoil

Almost exactly two years ago during the exhilaration of ?Arab Spring,? there were soaring hopes both inside Egypt and abroad that with the overthrow of the autocratic Hosni Mubarak, an era of democracy and human rights might be dawning.

Today despite the change of leaders from Hosni Mubarak to Mohammed Morsi, authoritarian rule in Egypt continues -- and so too in all likelihood will U.S. aid to that country.

For the current fiscal year, President Obama is requesting $1.55 billion in aid to Egypt, about 80 percent of it in the form of military assistance.

At this point, there appears to be no serious threat that Congress might block or cancel funds for Egypt, even given the arbitrary action?Morsi has taken in recent months ? such as his declaration that his decisions are immune from judicial review until a new constitution is adopted. On Sunday,?Morsi imposed a state of emergency in three Egyptian cities torn by riots and protests. Gen. Abdel Fattah al-Sisi, the head of the Egyptian military, warned Tuesday that the ?collapse of the state? would occur if the warring factions in the country did not come to terms.

Sen. John McCain, R- Ariz., who recently got back from a trip to the Middle East with other senators that included an interview with Morsi, told reporters Tuesday American aid should not be delayed while the U.S. waits for events to settle down in Egypt.

A delay might ?contribute to the chaos that may ensue because of their collapsing economy,? McCain warned. ?Their biggest problem is a collapsing economy. The Israelis are in favor of continuing the aid to Egypt. I think that?s important. We listen a lot to the Israelis.?

Illustrating a foreign policy divide in Republican ranks, Sen. Rand Paul, R- Ky., challenged secretary of state nominee Sen. John Kerry, D- Mass., at his confirmation hearing last week on why the United States should pay to send F-16 fighters to?Morsi?s regime.

Last September, in the aftermath of attacks on American diplomats in Libya and Egypt, Paul declared in a Senate speech, ?Not one penny more for Libya or Egypt or Pakistan until they act as our allies. Some say we have to keep sending it. Fine, let?s send it when they act as our allies. Let?s send it when they start behaving as civilized nations and come to their senses.?

?The American people are tired of this,? Paul said. ?Our Treasury is bare. There is a multitude of reasons why we should not continue to send good money after bad.?

According to a recent Congressional Research Service report, "Between 1948 and 2011, the United States provided Egypt with $71.6 billion in bilateral foreign aid, including $1.3 billion a year in military aid from 1987 to the present. Since 1979, Egypt has been the second-largest recipient, after Israel, of U.S. bilateral foreign assistance."

But in his opposition to more U.S. taxpayer subsidies for Egypt, Paul remains very much an outlier both in his party and in the Senate as whole.

Kerry explained to his colleagues last week that Egypt is simply too important for America not to fund.

?We have critical interests with Egypt,? he said. ?Egypt has thus far supported and lived by the peace agreement with Israel. And has taken steps to begin to deal with the problem of security in the Sinai. Those are vital to us and to our national interests and to the security of Israel.?

And on Tuesday an array of senators agreed with Kerry and McCain that the flow of U.S. funds to?Morsi must continue.

When senators are asked about funding, the term they use is ?engagement.? Asked whether the turmoil in Egypt should cause a pause in U.S. aid, Sen. Bob Corker, R- Tenn., the senior Republican on the Senate Foreign Relations Committee, said Tuesday, ?I don?t think it should affect our engagement, necessarily, with the country.?

Sen. Bob Casey, D- Pa., who has been serving as chairman of the Foreign Relations subcommittee on the Middle East, noted that ?I have always said when we provide aid, it?s never unconditional and we should always evaluate our aid in the context of what?s happening at a particular time. But I don?t favor these blanket aid bans that we often hear debated here (in the Senate).?

Another Democrat on the Foreign Relations Committee, Sen. Chris Coons, D- Del., who was on the recent trip to Middle East with McCain, said the senators? discussion with?Morsi touched on ?the importance of ongoing U.S. support for their economy, for their military,? as well as ?their progress toward full democracy? and Egypt?s adherence to its obligations under the 1979 peace treaty with Israel.

Coons noted that there has been a hold on U.S. economic development assistance for the Cairo regime since mid-2012.

According to CRS, Rep. Ileana Ros-Lehtinen, R- Fla., then chairwoman of the House Foreign Affairs Committee and Rep. Kay Granger, R - Texas, House Foreign Operations Appropriations Subcommittee chairwoman, placed holds on $450 million in economic aid to Egypt.
